These Terms of Service ("Terms") govern your ("you", "the advertiser") use of MustAI (the "Service"), a WhatsApp-based assistant for creating and managing advertising campaigns on Meta platforms (Facebook and Instagram). The Service is operated by COVENANT DEXTEROUS SERVICES PRIVATE LIMITED ("we", "us"), CIN U17299TG2020PTC141091, registered at SY NO. 32, 33, Beside #2-22/2/A, Rangampally, Peddapalli, Karimnagar, Telangana, India - 505172. By using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a company or a client, you confirm you are authorised to accept these Terms on their behalf. You give this agreement explicitly — by tapping "I Agree" the first time we message you on WhatsApp, or, if you reach the advertiser dashboard first, by checking the box there — and we record when you do.
The Service is for business use only, by advertisers aged 18 or older who have the authority to act on behalf of the business they represent. You must have a valid WhatsApp number and, to publish campaigns, your own Meta (Facebook/Instagram) ad account and Page. You must give us accurate information and keep it current.
You interact with the Service over WhatsApp to describe your business and campaign goals; the Service uses this information, together with AI-generated suggestions, to help you build ad creative and campaigns, which are published to Meta's advertising platform using your own connected ad account. You review and approve creative and campaign details before anything is published or any spend is authorized.
The Service depends on Meta's platforms (WhatsApp Business Platform, Marketing API) and on third-party AI providers to generate content — see our Privacy Policy for which providers are used and how. We do not control Meta's ad review process, ad account restrictions, or platform availability, and are not responsible for delays, rejections, or account actions taken by Meta. Features, integrations and limits may change as the Service develops.
The Service is currently offered as a beta. It may contain defects, be interrupted, or change without notice. No uptime or service-level commitment applies unless we agree one with you in writing, and beta access does not guarantee continued access to any particular feature. Please keep your own copies of business content and campaign information that matters to you. We may use feedback you send us to improve the Service, without disclosing your confidential information contrary to our Privacy Policy.
You log in to the Service using your WhatsApp phone number and a one-time code sent by WhatsApp. You are responsible for keeping control of that phone number and for all activity that happens through your account, and you must tell us promptly if you think someone else has gained access. Connecting your Meta account grants the Service permission to manage ad campaigns on your behalf, within the scope you approve; you can revoke this at any time from your own Facebook Settings.
Access to paid features requires an active subscription at the plan and price shown in the app at the time you subscribe. Subscriptions renew automatically for the same period until cancelled. Payments are processed by Razorpay; we do not store your card details. Taxes are charged as applicable law requires. We are not responsible for failures caused solely by a payment provider or banking network.
If a payment fails, we may pause your access to paid features, and campaigns you have already published continue to run on Meta under your own ad account and billing until you change them. Plan features, limits and prices may change on reasonable notice, and fair-use or rate limits may apply. Any usage credits included in a plan expire or carry forward only where the plan says so.
Advertising spend is separate from your subscription. What you pay Meta to run your ads is billed by Meta against your own ad account and is not part of our fee.
Cancellation and refunds are covered by our Refund & Cancellation Policy.
You are solely responsible for the content of your ads — including any AI-generated creative or captions you approve — and for ensuring it complies with Meta's advertising policies and all applicable laws. You must hold the rights, permissions and consents needed for any images, video, logos, trademarks and claims you give us. We may decline to publish or may remove content that we reasonably believe violates Meta's policies, these Terms, or the law.
You must not use the Service to:
We may investigate suspected abuse and restrict, suspend or terminate access where reasonably necessary to protect users, the Service or third parties.
The Service uses AI to draft captions and generate images and video. AI output can be incorrect, incomplete, outdated or unsuitable for your audience, and similar prompts can produce similar results for different advertisers. Review every AI suggestion before you approve it, particularly anything involving prices, claims, health or legal statements. We do not guarantee that AI output is accurate, unique, non-infringing, or that Meta will approve it. Nothing the Service produces is legal, tax, financial, medical or other professional advice.
You keep the rights you already hold in the content you give us. As between you and us, the ad creative and captions generated for you through the Service are yours to use for your own business, subject to the AI providers' own terms. Because AI-generated material may not qualify for copyright protection in every country, we cannot promise that any particular output is exclusively owned by you or that no one else will receive something similar.
You grant us a limited, non-exclusive, worldwide licence to host, process, reproduce, adapt and transmit your content only as needed to run the Service, do what you have asked us to do, keep the Service secure, and comply with the law. This licence does not include training AI models on your content, and we do not do so.
The Service itself, including its software, workflows, templates and branding, remains the property of COVENANT DEXTEROUS SERVICES PRIVATE LIMITED. If you believe content on the Service infringes your rights, email mustsubscriptions@gmail.com with enough detail to identify the work and the material concerned.
The Service connects to Meta, WhatsApp, AI providers and payment providers, each governed by its own terms. We do not control their availability, pricing, policies, approvals or account decisions, and any of them may change or discontinue an API. You authorise us to access your connected accounts only to the extent needed for the features you use, and you must comply with those platforms' terms rather than using the Service to work around them.
How we handle personal data is set out in our Privacy Policy, which forms part of these Terms. The Service has no facility for uploading customer lists or audiences of your own; Section 15 of that policy explains how we would handle such data if that ever changes.
We message you on WhatsApp to run the Service and to send a small number of updates we start
ourselves. You can stop those at any time by replying STOP or
UNSUBSCRIBE, and resume with START.
The Service is provided "as is" and "as available." We do not guarantee any level of ad performance, reach, leads, conversions, or return on ad spend, nor that any campaign or ad account will be approved — campaign results depend on factors outside our control, including Meta's ad auction and review, your targeting and budget choices, and market conditions.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, goodwill, business opportunity, anticipated savings, or advertising spend. For all other claims, our total liability is limited to the amount you actually paid us for the affected service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, and your mandatory rights as a consumer, where they apply, are unaffected.
To the extent permitted by law, you agree to cover us and our officers, employees and contractors against third-party claims, losses and reasonable costs arising from your unlawful use of the Service, from content you supply or approve, from your breach of these Terms, or from your violation of a connected platform's rules — except to the extent we caused them by our own unlawful conduct or gross negligence.
Your agreement is with COVENANT DEXTEROUS SERVICES PRIVATE LIMITED. Its directors, officers and staff act in their corporate capacities, and nothing in these Terms creates a personal guarantee by any of them. This does not limit any liability the law places directly on an individual.
You may stop using the Service at any time; see the Refund & Cancellation Policy for how cancellation affects billing. We may suspend or terminate your access for non-payment, security risk, unlawful activity, serious or repeated breach of these Terms, or where Meta or applicable law requires it. Where it is reasonable to do so, we will give you notice and a chance to put things right first.
On termination, your right to use the Service ends and any campaigns you have published remain under your own Meta ad account. We handle your data afterwards as described in the retention section of our Privacy Policy.
We may update these Terms from time to time; the "Last updated" date above will reflect the most recent change, and we will tell you about material changes through the Service. Continued use of the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of India. If a dispute arises, please contact us first and we will try in good faith to resolve it with you. Failing that, the courts at Hyderabad, Telangana, India have exclusive jurisdiction. If you are a consumer in a country with mandatory local protections, those protections continue to apply to you.
